OnOffGate – Privacy Policy

Preface

This page explains how INNOVA INSTALACIONES RL, S.L. (“we”, “our”, “us”) collects, uses, and discloses your Personal Data when you use the OnOffGate services (“Service”). Using our Service means any of the following:

  • purchasing a product from our webshop at https://www.onoffgate.com; and/or
  • downloading and using the OnOffGate smartphone application for iOS or Android; and/or
  • using any official OnOffGate smart-home integrations (e.g. voice-assistant skills) that we may offer.

We take the protection of all stakeholders’ and customers’ Personal Data seriously and comply with the EU General Data Protection Regulation (“GDPR”) and all other applicable data-protection laws.

1. Definition of Personal Data

“Personal Data” means any information relating to an identified or identifiable natural person (“data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, online identifier, or one or more factors specific to that natural person’s physical, physiological, genetic, mental, economic, cultural, or social identity.

2. What Personal Data We Process

We process the Personal Data that we obtain in the course of our business relationship with you. This may include:

  • name, postal address, e-mail address and other contact details
  • identity-verification data (e.g. national ID or VAT number where required)
  • order, payment, and delivery information
  • usage data from the OnOffGate app or connected devices (see §7)
  • marketing preferences and communication history
  • data we must keep to fulfil legal obligations (e.g. invoices, accounting records)

These data are obtained directly from you or—where lawful—from third-party partners (e.g. payment processors or shipment providers).

3. Purposes and Legal Bases of Processing

Providing the requested Personal Data is voluntary; however, if you do not provide the data needed to conclude a contract or to use certain app features, we may be unable to deliver products, execute the contract, or continue providing the relevant services.

4. Data-Retention Period

We retain Personal Data only as long as necessary for the purposes stated above or as required by law (e.g. tax and commerce retention periods) and while potential legal claims are not yet time-barred.

5. Recipients of Your Personal Data

We disclose Personal Data only where necessary and lawful:

  • public authorities or courts when legally required
  • shipping and logistics providers
  • accountants, auditors, and tax advisers
  • insurers for handling insurance claims
  • IT-service providers (hosting, maintenance, support, e-mail, analytics)
  • after-sales and marketing partners only where you have consented

All recipients are contractually bound to protect your data and may process them only for the stated purposes.

6. Your Rights

You have the following rights under the GDPR (subject to statutory conditions):

  • Access – to know whether we process your Personal Data and to obtain a copy
  • Rectification – to correct inaccurate or incomplete data
  • Erasure (“right to be forgotten”) – to delete data processed unlawfully or no longer needed
  • Restriction – to limit processing to specific purposes
  • Data portability – to receive the data you provided in a structured, machine-readable format
  • Objection – to object to processing based on legitimate interests or direct marketing
  • Complaint – to lodge a complaint with a supervisory authority in the EU

7. OnOffGate App & Connected Device Data

The OnOffGate app transmits Personal Data to our servers only when it is required for an activated feature:

  • Account registration for cloud/remote access – e-mail address
  • RemoteConnect feature (optional cloud relay) – device serial number and the label of the respective digital key
  • Push notifications that rely on RemoteConnect – serial number, digital-key name, and preferred app language
  • Firmware updates of an OnOffGate device – device serial number

All transmitted data are stored in encrypted form.

8. Cookies on https://www.onoffgate.com

Our website uses cookies—small text files stored on your device—to enhance user experience. Cookies are pseudonymised; they may store, for example, your language preference or form-auto-fill entries, and aggregate analytics (e.g. visit frequency, pages viewed). You can accept or refuse cookies in your browser settings; refusing may limit certain website functions.

9. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will post the revised version and—where legally required—seek your consent to material changes. The “Last updated” date at the top indicates when the latest revisions took effect.
